BornWhere is operated by EMEA Partners OÜ, a company registered in Estonia under registry number 12367591.

By using our website or placing an order, you agree to these Terms of Service. Please read them carefully before making a purchase.

Nothing in these Terms limits any mandatory rights you have under applicable consumer protection law.

1. About BornWhere

BornWhere creates personalized clothing inspired by places that matter to you.

Many of our products are customized using information selected or provided by the customer, including postcodes, locations, text, colors, or other design options. As a result, personalized products are produced specifically for the individual customer.

2. Eligibility

By placing an order through our website, you confirm that you have the legal capacity to enter into a binding contract or that you have the permission of a parent or legal guardian where required.

You agree to provide accurate, complete, and current information when placing an order.

3. Products and Personalization

We make reasonable efforts to display our products, colors, designs, sizes, and other characteristics accurately.

The appearance of colors may vary slightly depending on your device, screen settings, production process, and materials.

For personalized products, you are responsible for checking all information you provide or select before submitting your order. This includes your postcode, location, spelling, size, color, and other personalization choices.

Products correctly produced according to the information submitted with your order are not considered defective simply because the customer later decides that different personalization, sizing, or other options would have been preferred.

This does not affect your statutory rights where a product is defective, damaged, incorrectly produced, or otherwise does not conform to the contract.

4. Orders

When you place an order, you are making an offer to purchase the selected products under these Terms.

After placing your order, you will receive an order confirmation at the email address provided during checkout.

We reserve the right to reject or cancel an order where reasonably necessary, including in cases of suspected fraud, payment problems, obvious pricing or technical errors, product unavailability, or personalization that we cannot reasonably produce.

If we cancel an order after payment has been received, we will refund the applicable amount.

5. Personalized Orders and Changes

Because personalized products may enter production shortly after an order is placed, changes or cancellations may not always be possible.

We will make reasonable efforts to update your order if production has not started, but we cannot guarantee that changes or cancellations can be made once production has begun.

6. Prices and Payment

Prices are displayed on our website in the currency shown at checkout.

Where applicable, prices include VAT or other taxes as required by law. Any additional delivery costs or other charges applicable to your order will be displayed before you complete your purchase.

Payment must be made using one of the payment methods available at checkout.

Your order will not be processed until payment has been successfully authorized or otherwise confirmed.

7. Shipping and Delivery

Our products may require production time before shipment, particularly where an item is personalized or made specifically for you.

Estimated production and delivery times are provided on our website or during checkout. These are estimates and may be affected by the destination, carrier delays, customs procedures, public holidays, weather, or other circumstances outside our reasonable control.

8. Right of Withdrawal

Consumers purchasing online in the European Union generally have the right to withdraw from a distance contract within 14 days of receiving the goods, subject to exceptions provided by law.

Personalized Products

The statutory right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalized.

Accordingly, products created specifically using your selected postcode, location, text, or other individual personalization cannot normally be returned or refunded simply because you change your mind.

This exception does not affect your rights if the product is defective, damaged, incorrectly produced, or otherwise does not conform to the contract.

Non Personalized Products

Where you purchase a product that has not been personalized or made to your specifications, you may have a statutory 14 day right of withdrawal in accordance with applicable consumer law.

9. Defective, Damaged, or Incorrect Products

If you receive a product that is damaged, defective, incorrectly produced, or does not match what you ordered, please contact us at contact@bornwhere.com.

Please provide your order number, a description of the problem, and photographs where reasonably necessary to help us assess the issue.

Where a product does not conform to the contract, you are entitled to the remedies available under applicable consumer protection law.

Nothing in these Terms excludes or limits those statutory rights.

Where a refund is due, it will normally be made using the original payment method unless otherwise agreed.

Purchasing a BornWhere product does not transfer ownership of any intellectual property rights associated with the brand or design.

12. Customer Submitted Content

Where our website allows you to provide text, locations, personalization details, images, or other content for use in a product, you confirm that you have the right to use that content and that its use by BornWhere for the purpose of fulfilling your order will not unlawfully infringe the rights of another person.

We reserve the right to refuse personalization that we reasonably believe violates these requirements.

In Estonia, eligible consumer disputes may be submitted to the Consumer Disputes Committee operating through the Consumer Protection and Technical Regulatory Authority.

Your statutory right to seek remedies through the courts is not affected.
